Mobile Home Communities Rules and Regulations

1. Park Rules and Regulations

1.1 General Conditions

  1. All rules and regulations will be strictly but fairly enforced. You will be notified of any violations and provided with an opportunity to cure them. If a violation is not cured within the specified time, the landlord may institute legal remedies, including eviction, as permitted by law.
  2. The interpretation, explanation, addition, deletion, and enforcement of these rules are solely reserved for the landlord.
  3. The landlord reserves the right to revise, add to, or change these rules as necessary for the maintenance of a fine residential community. A thirty (30) day written notice will be provided to each tenant before implementing any new or amended rule. New rules will take effect thirty (30) days after posting unless a longer period is required by law. If you have any questions, please contact the landlord.

1.2 Registration

  1. All families contemplating entry into the park must complete an Application/Registration form prior to moving in. The application shall include but not be limited to:
    • The name and address of every occupant of the manufactured home.
    • The name and address of the owner of the manufactured home, if different from the tenant.
    • The names and addresses of all lienholders maintaining a lien against the manufactured home.
    • The serial number of the manufactured home.
    • The license numbers of all tenants’ and occupants’ vehicles, along with the state of issuance.
    • A registry of all occupants residing in the manufactured home.
    • All animals require a separate Pet Agreement.
    • All adult occupants and the owner of the manufactured home must sign this Application/Registration, acknowledging all facts contained therein. The Application/Registration sheet shall be available for inspection by law enforcement officers and updated periodically.

1.3 Manufactured Home Standards

  1. The landlord must be given a 48-hour notice before any manufactured home is moved into the park.
  2. No manufactured home shall be allowed unless it complies with the following minimum requirements, unless a waiver is obtained from the landlord:
    • All manufactured homes must be a minimum of twelve (12) feet wide.
    • Written approval from the landlord is required before any manufactured home is delivered to the park.
    • All manufactured homes must comply with HUD Manufactured Home Construction and Safety Standards currently in effect.
    • The exterior of all manufactured homes, additions, utility buildings, steps, porches, and skirting must be maintained in good repair at all times.
    • All exterior doors, windows, and siding must be in good repair. Metal roofs must be seal-coated to cover rust, and shingled roofs must be maintained. Proper window treatments (e.g., mini blinds or curtains) are required (no sheets, towels, or blankets).
    • Window air conditioners must be braced to the manufactured home with metal angle braces or chain braces. No bracing to the ground or cement work is allowed.
    • The tenant must provide proof of liability insurance protecting the park, other residents, and the landlord from damage or injury caused by the tenant, occupants, and invitees before occupancy. Proof of continued insurance must be provided upon request.
    • Above-ground utility services and utilities located entirely within the home must be properly connected, insulated, and protected by the tenant before occupancy. No home may be occupied without a Certificate of Occupancy from the town.
    • All exposed water lines from the water main must have heat tape. Heat tape should be HUD-approved, stainless steel protected cable, leading into a fused plug kit plugged into a GFCI receptacle or a regular receptacle controlled by a GFCI breaker. Once heat tape is applied, pipes must be wrapped in insulation. Heat tape must be installed by October 15th each year.
  3. Any additions (decks, ramps, porches, carports, garages, etc.) must be landlord-approved prior to construction and comply with local building codes. The tenant is responsible for applying for necessary permits.

1.4 Set-Up Standards

  1. A manufactured home must be installed and transported as required by law and as detailed in the INSTALLATION AND TRANSPORTATION OF HOMES addendum of the lease.
  2. The following set-up procedures must be completed before occupancy of any manufactured home:
    • Wheels and tires must be removed; axles, hubs, and springs must remain on the home at all times.
    • Manufactured homes must be lowered to a suitable level prescribed by local codes and tied down with devices meeting local and state requirements. Hitches must be removed, and the area skirted with the same type of skirting material as the home.
    • Manufactured homes must be skirted with park-approved skirting, which must be vertical aluminum or vinyl. Skirting must be completed within thirty (30) days after occupancy.
    • Each home may have one utility building, which must not exceed eighty (80) square feet (8ft x 10ft) and must be at least ten (10) feet from the home. Utility buildings must be anchored and maintained in good repair. Any additional cement required for enlarging the utility building pad must be approved by the landlord and comply with local and state codes. Metal sheds are not allowed.
    • Porches, steps, and decks must be maintained in good condition. All steps must have a handrail on at least one side and/or comply with all applicable regulations. Steps are required at all entrances/exits.
    • Fencing must be approved by the landlord before installation, including location, material, and length. Fencing must meet local building code requirements and not exceed four (4) feet in height. Fencing must be maintained in good repair and regularly trimmed. Pallets and 8ft privacy fences are strictly prohibited.
    • House numbers complying with local emergency/911 requirements must be clearly posted on each home.

1.5 Parking and Vehicles

(Towing of vehicles will be at the owner’s expense.)

  1. Parking is provided for two vehicles at each homesite.
  2. No parking is permitted on lawns anywhere in the park. Illegally parked vehicles will be towed at the owner’s expense.
  3. Trucks greater than ¾ ton designation are not permitted on site or in designated parking areas within the park.
  4. All motor vehicles must have current license plates and be in running condition. No vehicles may be used for storage. Vehicles found in violation will be towed at the owner’s expense.
  5. Boats, trailers, RVs, campers, unmounted truck campers, off-road vehicles, and snowmobiles must be stored outside the park unless used for loading or unloading within the same day.
  6. No vehicles may be worked on at the homesite or elsewhere in the park. Flat tires must be repaired within 24 hours.
  7. All traffic regulations, including speed limits and stop signs, must be observed. Failure to obey traffic signs constitutes a breach of the rules and grounds for eviction.
  8. Repairs to motor vehicles are not permitted in the community. Tenants are responsible for any damage caused to paved parking areas, including damage from leaking fluids. Tires must be removed from the park and cannot be stored on the property.

1.6 Safety and Conduct

  1. Tenants acknowledge that the park and landlord are not responsible for any loss due to damage or injury caused by fire, theft, accident, or any other cause. Tenants agree to indemnify and hold the landlord harmless from any suits, claims, or judgments arising out of their negligence or conduct. Tenants are responsible for the actions of all occupants and guests. Homeowners and renters must maintain insurance on their property and belongings at all times.
  2. Noise levels must be maintained at acceptable levels, as determined by the landlord. Loud music, including bass and amplifiers, is not permitted. Quiet hours are Monday-Friday from 10 PM to 7 AM, and Saturday-Sunday from 11 PM to 7 AM.
  3. Tenants are responsible for the actions of all occupants and guests.
  4. Peddling, soliciting, canvassing, or distributing literature by any group without permission from the landlord is prohibited.
  5. Traffic regulations must be observed throughout the park, with a 15 mph speed limit enforced. Tenants are responsible for their guests’ actions.
  6. Operations of mini bikes, motor scooters, dirt bikes, ATVs, go-carts, or snowmobiles are not permitted unless approved by the landlord. Licensed motorcycles may be ridden to and from the tenant’s homesite, provided they have quiet mufflers. Joyriding of any kind is prohibited.
  7. Tenants must keep their homesites free of fire hazards.
  8. Parking is prohibited within ten (10) feet of any fire hydrant located within the park. Vehicles must remain off the grass.
  9. No firearms, bows and arrows, BB guns, pellet guns, airsoft guns, fireworks (including sparklers and similar ground fireworks), or projectile-shooting toys may be discharged or used in the park.
  10. Small swimming pools no larger than five (5) feet in diameter and four (4) foot by four (4) foot sandboxes are allowed. Swimming pools must be emptied, deflated, and stored when not in use. No permanent swimming pools are permitted. Small swing sets must be maintained. Trampolines are strictly prohibited.
  11. No feeding of wild or stray animals. Outdoor pets or outdoor pet homes of any kind are not permitted.
  12. Central trash containers are for park and tenant use only. Any trash stored at the homesite must be in a sealed container with a securely fitting lid. Tenants found throwing trash on the
